Basically when I did the flapper mod a looong time ago, I most likely did not seat the diaphragm in good enough, hence the reason it came loose. Bike has been running fine, who knows how long it's been like this for. Can I throw this piece of crap away? Do I need to to anything to my bike?
thanks
Keep it as a souvenir on "how to not do the flapper mod"...

that thing just covers up the hole in the airbox. i've left mine attached to the airbox just for that reason. Some people have applied duct tape or epoxied a piece of plastic to cover the hole.

Once you install Mark's intake, you can throw that in the garbage :) Like said above, you've got a hole in the bottom of your airduct now... it's on the outside of the filters, so no biggy.
